The regular meeting of the Franklin Township Board of Trustees was called to order by Chairman Tim Guyton at 6:30P.M. September 29, 2011 at 2193 Frank Road. 

 

The Pledge of Allegiance was given.

 

Chairman Guyton gave the welcome.

MINUTES

         Chairman Guyton moved to dispense with the reading of the meeting minutes.

Trustee Johnson seconded the motion.  Vote taken: Guyton, yes, Cook, no, Johnson, yes.

 

         Chairman Guyton moved to approve the regular meeting minutes for September 15, 2011, as typed.

NEW BUSINESS

RESOLUTION #11-155

BILLS & PAYROLL 

 

Vice-Chairman Cook moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves payroll in the amount of $136,748.24 and bills in the amount of $154,891.53 totaling $291,639.74 from check #26066 to check #26161.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

RESOLUTION #11-156

CENTER CITY INTERNATIONAL 

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with City Center International for turbo and alternator replacement on International.  The cost is not to exceed $3,217.76.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

FIRE DEPARTMENT / CHIEF HOWARD

        

         Chief Howard did not have anything to report this evening.

 

ROAD DEPARTMENT / JIM STEVENS

 

         Jim Stevens asked the Board for one Resolution for House Bill #50 for trash removal.  

 

RESOLUTION #11-157

HOUSE BILL #50

1716 Jackson Road

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves the Road Supervisor to remove trash at 1716 Jackson Road, Parcel #140-001028-00 and to assess the cost to the property taxes.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

         Chairman Guyton said when Chief Timko was hired, he did not have his OPOTA Certification.  He said this is because he had been out of state for a period of time and his license had expired.  Chairman Guyton said Chief’s training had to be updated and because of this he was unable to work in a police capacity.  Chairman Guyton read a letter from the office of Mike DeWine, the Ohio Attorney General’s office stating “Enclosed is an Ohio Peace Officer basic training certificate for Albert J. Timko, Jr.  Please forward the certificate to the officer.  Sincerely, Jill Gregory, Certification Officer.” 

 

         Chairman Guyton said on April 28, 2011, the Board had extended Chief Timko’s probationary period to October 31, 2011 to make sure he would have time to complete this training. 

Chairman Guyton made a motion to take Chief Timko off of probation today, September 29, 2011.

Vice-Chairman Cook seconded the motion.  Vote taken: Guyton, yes, Cook, yes, Johnson, yes.  The audience applauded.

 

Chairman Guyton said that he announced at the last meeting about the community meetings that are being held by the Franklin Soil and Water Conservation District.  He said these are educational meetings.  The first meeting was at the Jackson Township Administrative Building with topics such as current problems in storm water quality, an overview of the National Pollutant Discharge Elimination System storm water permits and requirements, and future requirements of homeowners with aeration systems.  Chairman Guyton said there would be a meeting tonight at 7:00 P.M. at Madison Township and then another meeting on October 6, 2011 at Washington Township with one last meeting on October 19, 2011 at Blendon Township.  There was further discussion between the Board and residents in the audience about sewer systems, aeration systems, and tapping into the sewer system.  Chairman Guyton said a resident in the County may not be able to tap into a City sewer line without annexation.  The annexation requirement is different from area to area.  Bobbie Kean of 2889 El Paso Drive asked Jim Stevens when the sewer work would be completed and he said he has been told in October 2011.

 

RESOLUTION #11-142

FRANK GATES ANNUAL RENEWAL FOR 2012

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves the payment of $9,825.00 for Frank Gates Annual Renewal for 2012.  

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

         Chairman Guyton said that Public Health’s website, MyFCPH.org has a list of streets in the County that are high risk or low risk for the possibility of having illicit discharge.  He said they are going to start at the highest risk of streets and work down through to the lowest risk streets.  Chairman Guyton said the Mon-E-Bak area and the Brown Road East area were worked on first for sewers due to a complaint list.  He said the new method for creating future sewer lists is based on scientific data that is collected by Public Health.  This will assure that the worst areas are addressed the quickest while the areas that are causing the least problems, are held for later construction periods.  Chairman Guyton said they are forming lists of parcels that may be polluting the water, and after being informed by Public Health, the property owner will be forced to make the repair, replace the system, or tap into a sewer line, if one is in the immediate area.  

        

QUESTIONS FROM THE AUDIENCE

 

         John Spencer of 1616 Eastfield Drive asked the Board about three houses in his area where trash is never picked up.  Chairman Guyton said he was at the houses today dropping off literature.  Mr. Spencer was concerned if a resident would ever want to sell his house he couldn’t with the trash sitting in front of the houses in the area and with a smell of a city dump.  Chairman Guyton said the addresses have been turned over to Public Health as nuisance properties.  Trustee Johnson said the Board is aware of the properties.  Chairman Guyton said he has a meeting with the lawyers about charging the nuisance to the owner’s property taxes.  The Board and the residents in the audience continued the discussion about Local Waste and the nuisance properties and the residents who continue to not pay for the trash service.  John Fleshman of 3471 Lowell Drive told the Board he was under the impression that Local Waste would pick up trash at a residence even if the property owner did not pay the bill.  Trustee Johnson said there is no use having further discussion on trash since Chairman Guyton will be having a meeting tomorrow and he said the Board is going to continue to try to address the issue with one on one with the residents.  The Board and the residents in the audience had further discussion about Township residents putting trash bags out early in the week and that the Township residents do not know what day the trash is picked up.  Robyn Watkins of 3347 Dover Road suggested we put something on the website so the people would know when trash day is in Franklin Township.  There were two concerns on Longwood Avenue that Chairman Guyton and Jim Stevens would address.  Chairman Guyton reminded that trash containers have to have handles and not weigh over fifty pounds or Local Waste would not pick them up.  He said Local Waste should leave a note why a container was not picked up.

 

         Connie Price of 3719 Harding Drive talked to the Board about the homeless people in her area and how they share the drugs with each other.  Chairman Guyton said Chris Haydocy would be attending our meeting to talk to the Board about a bike hub off of Wilson Road behind Harding Drive.  Connie also asked the Board how much money the Township would be receiving from the Casino because of an article she read in the paper. Chairman Guyton said the article said how much money the County and City might receive from the Casino, but we still do not know how much the Township will receive.  Connie said she didn’t think anyone would go outside of the Casino because they would fear they would be mugged when they see homeless and crime in the area.  Chairman Guyton said there was a company from out of state that did a market study of what businesses and uses make the most sense around the Casino.  Chairman Guyton said Westland Mall is going to be redeveloped.  He said he heard there was a demolition permit coming and he said there is a major retailer that is going to relocate to the Hobby Lobby Store.  Chairman Guyton said to keep in mind that Georgesville Road and Broad Street would eventually have streetlights, street trees, sidewalks, and bike lanes and he said it is going to be a nice area.  Chairman Guyton said he would be attending another meeting with the City pertaining to negotiating a settlement on the Casino annexation and was hoping that the meetings with the City would be coming to an end.   Ralph Horn of 1610 Eastfield Drive North asked the Board if the Township would still be receiving a sum of money once a year for the next fifty years.  Chairman Guyton said the negotiations keep changing and that the City of Columbus may not be as generous as they were when negotiations were first started.

 

         Ralph Horn asked the Board about the provisions in the Local Waste contract.  Chairman Guyton said the only two points that are basically in the contract is how much the service is going to cost, the services that will be provided, and the day of the week that trash would be picked up in the Township.  Chairman Guyton said he has a meeting with the attorneys tomorrow about some of the issues.  Vice-Chairman Cook said the contract says Local Waste would provide weekly pick up.  Trustee Johnson said the contract does not say what would happen if a resident stops paying for the service.  Bobbie Kean of 2889 El Paso Drive thought there might be a problem of Local Waste not accepting electronic checks.  Chairman Guyton said he would check with Local Waste on this.  Chairman Guyton said to the residents in the audience that Local Waste service is no different than any other service you receive.  He said services such as your gas, electric, phone, or water would not be provided if payment had not been received.  John Fleshman said he has been hearing some negative comments about the trash service and Trustee Johnson asked John to call one of the Board members or have the resident call to let the Board know what the issues are that a resident may have.         

 

RESOLUTION #11-158

EXECUIVE SESSION FOR PERSONNEL

MATTERS IN THE POLICE DEPARTMENT 

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board goes into Executive Session for personnel matters in the Police Department.  The Board went into Executive Session at 7:37 P.M.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

Chairman Guyton moved to come out of Executive Session at 8:54 P.M. with no further business to discuss and no decisions having been made.  Vote taken: Guyton, yes, Cook, yes, Johnson, yes.
