The regular meeting of the Franklin Township Board of Trustees was called to order by Chairman Tim Guyton at 6:30 P.M. July 8, 2010 at 2193 Frank Road. 

 

The Pledge of Allegiance was given.

 

Chairman Guyton gave the welcome.

MINUTES

          Chairman Guyton moved to dispense with the reading of the regular meeting minutes for June 24, 2010 and the Special Meeting Minutes for June 10, 2010 and June 24, 2010.

Trustee Johnson seconded the motion.  Vote taken: Guyton, yes, Cook, yes, Johnson, yes.

 

                Chairman Guyton moved to approve the regular meeting minutes for June 24, 2010, as typed.

          Chairman Guyton said the Special Meeting of June 14, 2010 would be tabled until the next meeting on July 22, 2010 because the Township attorney needs to review and he is on vacation.

 

          Paul Wenning who is with the Board of Health and representing Franklin County Phase II NPDES / Storm Water Program gave his yearly update.  Their program participates with Ohio EPA to protect rivers and streams in Franklin County.  Through education and outreach they teach what goes into a storm drain immediately goes into a river. He said he needs help to educate the public.  Records should be kept of a count of how many people are informed as to what we are doing as a Township.  This count needs to be reported to Jennifer Fish, who is the coordinator of Public Education Outreach. A good housekeeping method should be in place of what we are doing to protect the sewers.    

 

Mr. Wenning said he is creating an inventory of where all the septic systems are located in Franklin County.  He said there are 20,000 septic tanks in the County and he is providing his list to Steve Renner, who is the new Franklin County Engineer. These septic systems are ranked from the best to the worst and then a long-term strategy is being developed.  Paul told the Board that Clime Road, Demorest Road and Talbot Place as well as Eureka Park, Fredericksburg Ave., and Savannah Drive are some of the worst in the Township.  He said the sewers on Brown Road and Mon-E-Bak are still on target to be started this year.  Mr. Renner will develop a plan based on the list Mr. Wenning gives him and target the areas, by ranking of, which sewers would be fixed first.

 

John Fleshman of 3471 Lowell Drive asked if the shovels would be in the ground for the Mon-E-Bak addition, but Mr. Wenning suggested that he should call Steve Renner for the answer.  There was continued discussion between the Board and residents about the work to be done in the Township.  Chairman Guyton said there would be dates and times for meetings given by the Franklin County Engineers for the work to be done in an area and Mr. Renner would answer all questions at that time.  Chairman Guyton said there would be flyers sent and detailed plans shown to anyone who is interested in the work that would be taking place in their area.

 

Nancy Ohde of 3459 Lowell Drive wanted to know if her old well would hold up with the work that would be done by the Franklin County Engineer.  The Board and Ms. Ohde had a discussion of the old wells in the area.

 

  Bobbie Kean of 2889 El Paso said she took a sample of the dirt in her front yard and had it analyzed.  She said it is toxic to people and animals.  She said her septic tank would not take another rain season.  She is very frustrated with the Franklin County Engineers Office.

 

Chairman Guyton said he was told there are capacity issues. The City is requiring the County to upgrade the pipe size for future users.  Chairman Guyton said this would mean additional funds for Mon-E-Bak.  Chairman Guyton said Steve Renner has EPA working against the City’s request and Chairman Guyton said there should be shovels in the ground for Mon-E-Bak this year.  He said the Franklin County Engineers have never let the Township down.  Mr. Wenning said the EPA told the County Commissioners that they want the areas to be sewered now.

 

OLD BUSINESS

 

          Chairman Guyton said the Board would work for one policy for computer use, but until a decision was made, the computers need to be put back in the Police Cruisers.  He said for the time being the Police Department would use the Sheriff Department Computer Policy.  This is a good guideline to use to get the laptops back into the cars.

 

          Chairman Guyton made a motion to institute the Franklin County Sheriff’s Office Computer Policy for the Police Department only and the Board directs Interim Police Chief Francies to have the laptops put back in the police cruisers.

Trustee Johnson seconded the motion but he said to change the wording on the policy from the Sheriff Department to Franklin Township.  Vote taken: Guyton, yes, Cook, yes, Johnson, yes.

 

          The Board had a discussion about LEADS for the cars in the Police Department.  Trustee Johnson thought the officers would need LEADS for protection. Chairman Guyton would like to know the cost for LEADS and the cost for the training.  Vice-Chairman Cook said the cost of LEADS would not be that much for the life of an officer.

RESOLUTION #10-121

BILLS & PAYROLL 

 

Vice-Chairman Cook moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves payroll in the amount of $152,229.74 and bills in the amount of $87,135.12 totaling $239,364.86 from check #22473 to check #22574.

RESOLUTION #10-126

CENTER CITY INTERNATIONAL   

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with Center City International for two (2) headlight assemblies and engine work on Medic 193.  The cost is not to exceed $1,580.86.

RESOLUTION #10-125

WINGFOOT COMMERCIAL TIRE   

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with Wingfoot Commercial Tire to replace four (4) rear tires on Extra Medic-192.  The cost is not to exceed $1,191.12.

RESOLUTION #10-124

EARLS    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with Earls for regular Preventive Maintenance and brake pads for Extra Medic 192, regular Preventive Maintenance for M193, and regular Preventive Maintenance for E-192.  The cost is not to exceed $1,495.60.

RESOLUTION #10-123

ACCUPRO AUDIO VIDEO, INC.    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with AccuPro Audio Video Inc. for two (2) additional security cameras for the building.  The cost is not to exceed $1,066.00.

 

Vice-Chairman Cook seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chairman Guyton said the Board would table the reimbursement to Garry Parkhurst for clothes from the Rugged Boot & Tractor Supply.  Jim Stevens had a medical emergency and could not make the meeting tonight to discuss this.

 

POLICE DEPARTMENT / CHIEF FRANCIES

 

          Bobbie Kean asked the Board about radar on El Paso because it is being used as a turn around on weekends and she is afraid for the small children on the street.  Chairman Guyton asked the residents that when they see an incident they need to get the make, model and description of the vehicle, license plate number, and what the driver looks like since there are only a total of ten officers out on patrol and two to three officers on a shift. 

 

          Mary Neymeyer of 1233 Brown Road asked the Board if they are doing anything about getting more officers.  Chairman Guyton said the Board is waiting for the new Police Chief to make decisions on the hiring of new officers.  The Board had a discussion of reserve officers. 

 

          Harold Goings of 142 Coolidge Avenue said an officer should come to his area and give citations for the residents who are parking their cars at an angle.  He said it is hard to see the small children who run between the parked cars.  Chairman Guyton said he would talk to Chief Francies. 

 

          Nancy Ohde had a discussion with the Board about Potter House Church.  Chairman Guyton said the Board has sent a letter to the Franklin County Commissioners to vacate Township Road Willowbend Lane from the northern edge of the right-of-way for Ponderosa Drive to the northern end of right-of-way on Willowbend Lane. 

 

          Chairman Guyton reminded the residents to empty such things as a birdbath or dog bowl, which might have standing water and breed mosquitoes.

 

FIRE DEPARTMENT / CHIEF HOWARD

 

          Chief Howard had a letter and Chairman Guyton read it.

July 8, 2010

RE: Converting Fire Fighter McGee S1 to Injury Time

Firefighter McGee received an on duty injury and has received a Worker’s Compensation number.  Firefighter McGee is requesting to have 190 hours of S1 and 13 Hours of Comp time converted to Injury time.

Chief Howard

            Chairman Guyton made a motion for the Fire Chief to convert 190 hours of sick time and 13 hours of comp time as injury time for Firefighter David McGee.

Vice-Chairman Cook seconded the motion.  Vote taken: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chief Howard requested an accident review for Truman Mullins as the driver at fault because he backed one of the Fire Department vehicles into a telephone pole.  He wanted to give Firefighter Mullins a verbal reprimand that goes into a file for one year since this is his first accident.  Chief said this might cost about $5,000.00 to replace the ladder and brackets.   He said they should be able to get loaner ladders from the City of Columbus.

Chairman Guyton made a motion to accept the accident review committee decision for driver Truman Mullins as an at fault driver for an accident on June 26, 2010 and for the Fire Chief to put a verbal reprimand in his file.  Chairman Guyton further moved to authorize the Fire Chief to put a verbal reprimand in Captain Kidd’s file for the same accident.

          Chief said he applied for EMS Grant with the Ohio Department of Public Safety for a refrigerator that locks to keep the medicine in.

RESOLUTION #10-098 (Amended)

APEX FIRE SERVICES    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with Apex Fire Services at a cost of $92.95 per element, per year for maintaining the turnout gear.  The cost is not to exceed $7,590.00 on an annual basis.

RESOLUTION #10-128

DISPOSE OF 18 JACKETS & 16 PAIRS OF PANTS

IN THE FIRE DEPARTMENT    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board deems the following items junk and authorizes the Fire Chief to dispose of eighteen (18) Fire Department jackets and sixteen (16) Fire Department pants.

 

Vice-Chairman Cook seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chief said Key-Tel has been hired to take care of the Township computers.  Chief said he would still need to follow up on a request by Vice-Chairman Cook about the cameras so the building could be watched off site.

 

          Chief said he would need to draft a letter to the Prosecutors Office about City Net and the breach of contract for the Township phones. 

 

          Chief said he and two of his firefighters would be going to Wisconsin to pick up the new fire truck and they might be back by July 22, 2010 for the meeting.  Chief invited everyone to come and look at the truck.  Chief said the truck would be here for National Night Out.  He said the sixteen-year old truck would be used as a reserve truck.  There was a discussion with the Board and Chief Howard about rust proofing and how much work is done on these trucks internally in the Fire Department to save the Township taxpayers money.

 

RESOLUTION #10-129

PIERCE MANUFACTURING    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to contract with Pierce Manufacturing for change order invoice #M35576.  The cost is not to exceed $3,675.00.

 

Vice-Chairman Cook seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chief announce that Firefighter Daryl Jordan had a little girl on July 1, 2010.

 

          The Board and Chief Howard discussed the new shirts for the Fire Department.  Chief thinks the button down shirts look more professional than any of the other shirts that they have looked at.

 

          Chairman Guyton said if there are any nominations for the Juanita Kaufman Award that they need to be turned into the office by July 21, 2010 at 5:00 P.M. because the Board would need to review before the next meeting.

 

          Chairman Guyton gave an update on Township-wide trash.  He said all entities that are in Consortium II need to share cost of advertisements.  The recycling portion will be awarded on July 29, 2010, but Franklin Township is not participating in the recycling portion.  Chairman Guyton said bids for basic trash pick up would be August 26, 2010 and the actual bid for that would be awarded on September 29, 2010 to the winning hauler. 

 

          Connie Price of 3719 Harding Drive said she would prefer if there were increases for trash pick-up during the next five years instead of one big increase at the end of five years.  Chairman Guyton said when the bids come in, that is when the Board would know the cost and the Board is trying to achieve the lowest cost for the residents.  There was a discussion with the Board and the residents about fuel surcharge and the increase for tipping fees. Chairman Guyton said the cost for 2011 on a weekly basis would be $.08 per week more per household for one ton of garbage, which is $3.00 per ton for the increase that is being proposed.

 

Harold Goings of 142 Coolidge Avenue said his hauler has never increased the price after forty years.  He pays $16.00 a month, has a Senior Citizen Discount, alley pick up, and he says the Board does not have the right to tell him who hauls his trash away.  The Board and Mr. Goings had further discussion about what the Board is trying to achieve for the residents with the cost, Senior Citizen discounts and if they currently have alley pickup, the Board is trying to put that into place too, but Mr. Goings wants guarantees.

 

There was continued discussion of the trash pickup for the Township with complaints about the day of the week that trash would be picked up, the residents didn’t feel they should be dictated as to who hauls their trash, and there should be better ways to communicate since many did not receive a Newsletter to give their opinions on this. 

 

Chairman Guyton said the Board of Health was at the last meeting to hear these concerns from the residents, but no one was here.  Chairman Guyton said Franklin Township leads the calls of complaints in Franklin County and Melissa, who is with the Board of Health said 100% of the complaints would go away if there was a single hauler contract in the Township.

 

Vice-Chairman Cook said he is not for or against Township-wide trash.  He said he thinks the residents have been lied to from the beginning when the first Resolution was read.  He said he would need to see that a letter is sent to every resident in Franklin Township and after seeing the majority of the responses he would then vote for what the majority of the residents want.

 

Chairman Guyton read a letter from the Davenports of 1788 Belmead Avenue.

June 28, 2010

Dear Trustees,

We are planning our 14th annual party and would like to request to close down Shady Lane between Belmead Avenue and Linnet Avenue on July 10, 2010 at about 2:00 P.M. until 2:00 A.M.  This is so we can have enough parking and not worry about our guest and neighbors safety.

We took this letter around to our surrounding neighbors and asked them to read and sign this letter.  This takes care of two purposes.  First so that we could invite them and second so that they would be aware of what was going on in the neighborhood.

Chairman Guyton made a motion to approve the closing of Shady Lane between Belmead Avenue and Linnet Avenue on July 10, 2010 from 2:00 P.M. until 2:00 A.M.

Trustee Johnson said if the Davenports would change the time from 2:00 A.M. to 1:00 A.M., he would second the motion.  There was a discussion on the time and the Davenports agreed to the change.

RESOLUTION #10-120 (Amended from Resolution #10-116)

OLD GENERATOR IS SOLD TO RALPH UNDERWOOD   

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to sell the old generator to Ralph Underwood for a cost not to exceed $1,225.00.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chairman Guyton said on June 14, 2010, the Board interviewed four candidates for the Police Chief position.

 

RESOLUTION #10-127

OFFER EMPLOYMENT TO

ALBERT JAMES TIMKO     

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves to offer employment to Albert James Timko as the next Police Chief of Franklin Township effective August 2, 2010.

 

Vice-Chairman Cook seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

          Chairman Guyton said there is a compensation package that is offered to the new Police Chief.  His wage increase would be put aside for five years.  At the end of five years, the Board would either extend the current contract or negotiate a new contract.

 

RESOLUTION #10-119

ADVANCE FUNDS    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board approves an advance in the amount of $80,000.00 from the General Fund 1000-920 to the Fire Fund 2191 for cash flow.

 

Trustee Johnson seconded the Resolution.  The roll was called for its adoption and the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes.

 

RESOLUTION #10-122

2011 ANNUAL BUDGET    

 

Chairman Guyton moved for the adoption of the following Resolution.

 

BE IT RESOLVED by the Board of Trustees of Franklin Township of Franklin County, Ohio, that the Board accepts the Annual Budget for the year commencing January 1, 2011:

          Chairman Guyton said that the Board did not need to do anything further with the Rumpke contract because Chairman Guyton had settled this with a phone call.

 

          Vice-Chairman Cook said we are still working on getting the flagpoles from the old Delphi site, which belongs to the Township.  They are to be moved to the cemetery.
