the Franklin Township Board of Trustees was called to order by Chairman Tim
Guyton at 6:30 P.M. December 8, 2011 at 2193 Frank Road. The Pledge of Allegiance was given. Chairman Guyton gave the welcome. ROLL

Guyton moved to dispense with the reading of the regular meeting minutes for
November 23, 2011. Trustee Johnson seconded the motion. Vote taken: Guyton, yes, Cook, yes,

Guyton moved to approve the regular meeting minutes for November 23, 2011, as
typed. Trustee Johnson seconded the motion. Vote taken: Guyton, yes, Cook, no,

Guyton said Kate Matheny with Franklin County was present this evening to
discuss the Green Lawn Abbey with the Board. Ms. Matheny gave the Board a
folder of pictures, which showed the special features of the Abbey such as
the marble and the stained glass windows.
She said there is a group of volunteers who maintain the abbey and the
surrounding area. Ms. Matheny said the building is open upon request for
tours and open on Memorial Day. Ed
Seeger of 1870 Richmond Road said the building sits back off of the corner of
Harmon Avenue and Greenlawn Avenue.
There was a discussion between Ms. Matheny and the residents in the
audience about the event that was held there in July. She told the Board there are broken
windows, which they are working on to replace. Ms. Matheny said donations are being accepted online through
Greenlawnabbey.org to help with the repairs. NEW BUSINESS RESOLUTION
#11-178 BILLS &
PAYROLL Vice-Chairman Cook moved for the adoption of the
following Resolution. BE IT RESOLVED by the Board of
Trustees of Franklin Township of Franklin County, Ohio, that the Board
approves payroll in the amount of $149,166.25 and bills in the amount of
$245,656.43 totaling $394,822.68 from check #26637 to check #26777. Trustee Johnson seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. Vice-Chairman Cook read the purchase requests: Fire Department: 11-238 Earls Truck Service – Two

#11-187 P.P.I GRAPHICS Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of
Trustees of Franklin Township of Franklin County, Ohio, that the Board
contracts with P.P.I. Graphics for three thousand (3,000) traffic citations, which are $379.26
per thousand (1000) in books of twenty-five (25). The cost is not to exceed $1,137.78. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. RESOLUTION
#11-188 VANCES LAW
ENFORCEMENT SUPPLY Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of
Trustees of Franklin Township of Franklin County, Ohio, that the Board
contracts with Vance’s Law Enforcement Supply for four (4) Remington Model
870P Shotguns minus a $545.00 trade-in and an additional trade-in of
$440.00. The cost is not to exceed
$1,740.00. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and

#11-189 JONES TRUCK &
SPRING Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of Trustees
of Franklin Township of Franklin County, Ohio, that the Board contracts with
Jones Truck & Spring for right front spring for E192 plus parts and
alignment. The cost is not to exceed
$1,414.88. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. RESOLUTION
#11-190 OHIO FIRE CHIEF’S
ASSOCIATION Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of
Trustees of Franklin Township of Franklin County, Ohio, that the Board
contracts with Ohio Fire Chief’s Association for Lieutenant and Captain
Promotional Exams, Part 2 Assessment.
The cost is not to exceed $10,500.00. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. Ben
Weiner, who is with the Franklin County Economic and Development Department,
attended this evening to present to the Board, the finalized Scioto /
Franklin Neighborhood Plan, which is a Land Use plan for the northern part of
Franklin Township. He said this was a
project initiated from a request by the Board and a community consensus for
that part of the Township. He said
there were two public meetings that residents participated in. He said the document that he presented to
the Board would be used by the Franklin County Planning Commission and by
Franklin County Zoning. Mr. Weiner
said the Franklin County Commissions would reference the document for all
proposed developments in this area to assure that the community needs were
met. The Board thanked Mr. Weiner for
the presentation. The Board, Mr.
Weiner, and the residents in the audience had further discussion of the plan
and the area that the plan would cover.
Chairman Guyton said this plan is for the area from the railroad
tracks just north of Broad Street to Trabue Road, I-270 on the west, and the
Scioto River on the east. He said the
Southwest Area Land Use Plan covers from the railroad tracks just west of 3C
highway on the west, to I-71 south on the east, I-270 on the south, and Mound
Street on the north. Mr. Weiner said
the Westland Area Interim Development Framework covers the area around the
Casino. He said this is the only
Township with three plans. FIRE DEPARTMENT / CHIEF HOWARD Chief
Howard said one of the drivers in the Fire Department made a decision to
avoid hitting the vehicle in front of him, to drive the engine up on the
curb, which caused damage to the suspension.
The Accident Review Board said the driver was at fault. Chief said the driver has not had any
accidents in the last year and he said the Fire Contract says this accident should
be a verbal reprimand. Chief said the
driver has only had a couple accidents in his twenty-seven years with the
Township. Chairman Guyton made a motion that the Board accepts the
Fleet Review Board’s opinion of driver at fault for Truman Mullins for the
accident on November 17, 2011. Vice-Chairman Cook seconded the motion. Vote taken: Guyton, yes, Cook, yes,
Johnson, yes. Chief
Howard has two requests for Family Medical Leave. He said Jason Roshon is requesting four days to be approved
because of childbirth scheduled on December 14th. Chief said the second request is from Charles
Adams, who is requesting four days with a due date for his baby around
December 15th. Chief
Howard said nine of his firefighters / paramedics would be completing their
CPR Training by the middle of January and will be certified as CPR
Instructors. He said therefore we
would be able to offer a CPR course to any of the Township residents. Chief Howard said he has already discussed
this with Chief Timko about providing a CPR class to the Police Officers
since they are the first to respond to an accident. Chief
Howard has also discussed with Chief Timko about the police officers taking
TB tests. Chief Howard said the tests
should be given on an annual basis since the officers could be exposed to TB. ROAD DEPARTMENT / JIM STEVENS Jim
Stevens said he was told there was a proposal for this year to finish the
paving on Little Avenue, east of Brown Road, West Park Avenue, and Brookside
Blvd. He said the Mon-e-Bak Area has
the worst roads and Jim is concerned about the snowplows being torn up because
of the condition of the roads. Jim
said the work is going to stop for Fisher Road and in some of the areas on
Hague Avenue. He said the work got
behind because of the hard rock that they found in a few of the project
areas. Jim
Stevens said the Road Department has been working on drainage issues in the
Township. He said due to all of the
sanitary sewer construction, our catch basins, drains, and ditches have been
filled up with gravel and some pipes have collapsed. Jim said with all of the rain, he was
called out one evening because of the flooding. Chairman Guyton said Jim is telling both the contractor and the
County that they must put everything back to good working order before they
sign-off on the project next spring and he is adamant that they flush all of
the lines before pulling out of the areas.
The Board, Jim Stevens, and the residents in the audience had further
discussion about the construction work with the flooding and standing water. Jim said some of the concerns the
residents had were County roads. RESOLUTION
#11-183 TRANSFER FROM
GENERAL FUND TO PERMISSIVE
MOTOR VEHICLE FUND Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of
Trustees of Franklin Township of Franklin County, Ohio, that the Board
approves the transfer of $1,200.00 from the General Fund to the Permissive
Motor Vehicle Fund #2231. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. RESOLUTION
#11-186 TRANSFER FROM
GENERAL FUND TO PERMISSIVE
MOTOR VEHICLE FUND Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of Trustees
of Franklin Township of Franklin County, Ohio, that the Board approves the
transfer of an amount of $3,800.00 from the General Fund to the Permissive
Motor Vehicle Fund #2231 for the I350 dump truck. Vice-Chairman Cook seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. Chairman
Guyton said the Board just signed the second phase of the House Bill #50 paperwork to be forwarded to the County
Auditor for work performed this year and when the property taxes are paid,
the money will be placed in the General Fund. Jim Stevens said the Road Department fronts the money for the
work they do for House Bill #50 and then it is paid back from the transfers
made by the General Fund. POLICE DEPARTMENT / CHIEF TIMKO Chief
Timko thanked the Board for the purchase of the shotguns. He said we are constantly replacing old
equipment for the safety of the officers in the Police Department. Chief
Timko said he sent the Board a notice about a Mutual Aid Contract. He said some of the language in the
contract would still need to be reviewed.
Chairman Guyton asked Chief if this is a contract that the Board would
need to sign every year and Chief said it has to be signed when it is updated. Chief said the nature of the Mutual Aid
Contract is if something would happen in the Township, other police
departments could come in and provide support for an incident. Chief said it allows us to help other
jurisdictions if it is needed.
Vice-Chairman Cook was concerned if the Township only had one car on
duty in the Township and we responded to another entity, we would leave our
Township without support of an officer.
Chief Timko stated that we don’t have to help with the incident in
that case. Chief said it is not
mandatory that we help if we do not have enough officers to respond to that
situation. Chairman Guyton said even
if we have two officers on the street, we might not be able to help with
these other situations. Chief said we
would probably be the beneficiary from the Mutual Aid rather than our
officers being able to help in other areas.
Chairman Guyton said the residents already say we do not have enough
officers. Chief said the main concern
is to keep our officers here in our community. Chief
Timko told the Board that the traffic citations that the Police Department is
ordering from P.P.I. Graphics in the Resolution that was made earlier this
evening would come out of the Traffic Fine Money and not the Police
Department Budget. Chief said those
citations that we are ordering should last approximately two years. RESOLUTION
#11-184 CONTRACT FOR 2012
WITH LOVELAND
& BROSIUS LLC Chairman Guyton moved for the adoption of the following
Resolution. BE IT RESOLVED by the Board of Trustees
of Franklin Township of Franklin County, Ohio, that the Board approves to
contract with Loveland & Brosius, LLC, as the attorneys on retainer for
Franklin Township for calendar year 2012.
Trustee Johnson seconded the Resolution. The roll was called for its adoption and
the vote was as follows: Guyton, yes, Cook, yes, Johnson, yes. Chairman
Guyton said whenever possible the Township uses the County Prosecutor’s
Office, which is free, but when they are not available, we use Loveland &
Brosius. Chairman
Guyton said the Board should have the Newsletter to review at the next
meeting in two weeks. Chairman Guyton asked the Board
if the meeting for December 22, 2011 could be moved from 6:30 P.M. to 1:00
P.M. The other two Board members
agreed. QUESTIONS FROM THE AUDIENCE Barry
Rowat of 1811 Longwood Avenue has a neighbor who is not having their trash
picked up. Mr. Rowat thought the
trash would be picked up at a residence no matter what and added to their
property taxes. Chairman Guyton said
that is still being reviewed by the attorneys. Mr. Rowat gave the Board the
address and the pictures of the property.
Chairman Guyton said he would stop at the house and discuss the trash
with the resident. Chairman Guyton
said it takes time to notify the owner through a certified letter and if the
resident does not comply then the Road Department would pick up the trash. Ralph Horn
of 1610 Eastfield Drive North asked the Board if there is a printout of the
residents in the Township who have not paid their bill. Chairman Guyton said the Board would
receive a printout on Monday, the day after the trash is picked up. Mr. Horn was asking about unpaid bills on
Eastbrook Drive and Chairman Guyton said he would forward the list that he
receives from Local Waste to Mr. Horn.
Barbara
Luckhaupt of 1296 Hart Road said the new renters at 1311 Hart Road might not
know the rules and regulations of the trash service since they are new in the
area. Chairman Guyton said he would
stop by and talk to them. Barry
Rowat had a question for Chief Timko about vehicles that are parked at a
residence that do not have license plates on them. Mr. Rowat thought the vehicles should have plates and Chief
Timko said the Police Department would check into this and notify Paul Eberts
with Public Health. Chief
Timko told the Board that Officer Jason Huston has completed his probationary
period. He complimented him on doing
a good job for the Township. Chief
wanted to let the Board know that Jason is a full time employee now. Chief said Officer Moore is still on
probation and is currently on military orders for two weeks with National
Guard Duty. Ralph Horn
asked the Fiscal Officer about finances.
Lisa Morris said there was a freeze on salaries for 2012. Ralph asked Chairman Guyton about
negotiations with the Casino.
Chairman Guyton said he had a meeting with Mayor Coleman on November
28th and he has another meeting with our `attorney and
representatives of the City on December 14, 2011. He is hoping this will be the last meeting. Chairman Guyton said the results from the
discussions of that meeting would have to go to the Mayor, the Council, and
the Franklin Township Board of Trustees for adoption. Chairman
Guyton moved with no further business to discuss to adjourn the meeting. Trustee Johnson seconded the motion. Vote taken: Guyton, yes, Cook, yes,
