The regular meeting of the Franklin Township Board of Trustees was called to order by Chairman Tim Guyton at 5:30 P.M. July 24, 2008 at 2193 Frank Road.
The Pledge of Allegiance was given.

NEW BUSINESS
RESOLUTION #08-072 PAYROLL AND BILLS
Trustees Cook moved for the adoption of the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Oho, that the Board approved payroll in the amount of $116,025.82 and bills in the amount of $19,264.36 totaling $135,290.18 from Check #16164 to check #16278.

Donald Brosius, Attorney-at-Law, for Franklin Township and Steve Leidinger, Attorney came to the meeting at the request of the Board of Trustees for Franklin County, Ohio to give an overview of the annexation laws pertaining to Townships. Mr. Brosius brought papers pertaining to the new annexation laws that were enacted on March 27, 2004. They had a lengthy discussion o the different ways an annexation request can be filed. Mr. Brosius stated the new laws mad annexation a whole lot easier.
What’s going to happen is the people are going to Columbus and they are going to say we need water and sewer and Columbus will say “That’s fine but you need to annex”. “Then they are going to sign and say to annex,” said Mr. Brosius.
Mr. Brosius also stated that because Franklin Township has a “Fire District” rather than a “Fire Department”. Once the properties are annexed, the township loses that tax base. Legally, by simply changing from district to department, the law would allow Franklin Township to keep the taxes on properties that get annexed. The catch is that the change involves not only a name change, but the past funding would have to be voted on again and everybody would have to vote.
Mr. Brosius said the Board of Trustees should immediately send all annexation requests to hi in the future for review and to make sure the township businesses are happy with the services they are receiving. The thing to do to be proactive is to talk with the property owners ahead of time and ask them if there is anything the Board can do.

RESOULUTION #08-065 PHYSIO-CONTROL, INC.
Trustee Cook moved for the adoption of the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Ohio to approve the purchase of a 2008-2009 annual maintenance contract for department life packs at a cost of $4,222.71.

RESOULUTION #08-066 CENTER CITY INTERNATIONAL
Trustee Cook moved for the adoption of the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Ohio to approve the replacement of turbo charge in medic M-193 at a cost of $2,819.24.

CHIEF CASTLE
I need the Chairman of the Board to sign papers for a grant, which I have applied for. I have applied for us to get 6 Mobile Data Terminals for our cruisers. This would enable us to receive data and we will not be reporting with these terminals. The only cost to us will be a monthly charge for the communication cards. This will be discussed with the FOP Labor Relations Meeting on August 7, 2008.
We are receiving 4 new 2008 Ford Crown White Victoria’s. I would like to wait until I return from vacation to have these delivered so that I can take care of the insurance and lettering. The car dealership will deliver these cars at a $75.00 charge per car. I propose we have the cars delivered instead of tying up our personnel. It is more cost effective to pay the $75.00 charge per car.
The power and the backup generator at Fire Station 192 at 4100 Sullivant Ave. went out when the station was struck by lightening on July 21, 2008. Trustee Cook said the starter does not work and the whole generator needs replaced. Chief Howard said it would be a whole lot cheaper to buy a whole updated system rather than buy a part to fix the generator due to its age.
Trustee Cook said the estimate he received from the insurance company shows they would pay up to $13,580.00 to bring the fire station back to their pre-loss condition. To bring it up to date where there would be power on half of the building is a little over $3,000.00 a total of $16,525.00. To put the whole building on generator, it would cost $20,100.00. We would have to do the electrical work, cement pad, and underground wiring. Chairman Guyton said it is possible the Township can collect more than $13,580.00 because of the associated expenses with replacing the generator.
RESOLUTION #08-068 ESP, INC.
Trustee Guyton moved for the adoption of the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Ohio to contract with ESP, INC. for a new 40 KW Generator which will be used to provide emergency back up for The entire electrical service for Station 192, not to exceed $23,100.00 We will provide the concrete pad, gas line work, disconnect old electric service and remove old generator.

Trustee Cook said that he talked with Paul Ebert about 1305 Brown Road and again they did not send the information registered mail and they could not prove that the person at 1304 Brown Road received the letter. It is being delivered today and they will watch and make sure that they comply.
CHIEF HOWARD
Chief Howard gave the Board a Certificate of Estimated Property Tax Mileage Rates. Chief Howard went over the rates with the Board to discuss which mill to request from the voters. We need to have the information in by August 21, 2008 at 4:00 P.M. to the Board of Elections. We need to have this information in to the Prosecutor’s Office for their review and approval. Before anything is final, it must be taken to the Board of Elections.
RESOLUTION #08-067 DECLARING IT NECESSARY TO LEVY A TAX IN EXCESSS OF TEN MILL LIMITATION AND TO PROCEED TO BALLOT (R.C. SECTION 5705.19) FIRE DISTRICT LEVY
Chairman Guyton moved for the passage of the following resolution.
WHEREAS, the Board foresees the need to levy a tax outside the ten mill limitation for the support of fire prevention and suppression within the fire district, and
WHEREAS, a resolution was previously passed pursuant to R.C. Section 5705.03 requesting the County Auditor to issue a certificate for the number of mills necessary to produce $700,000 and said certificate has been received by the Township.
NOW, THEREFORE, BE IT RESOLVED by the Board of Township Trustees of the Township of Franklin, Franklin County, Ohio;
Section 1. That the Board of the Trustees of Franklin Township, two-thirds of all members elected thereto concurring, declares that the amount of taxes within the ten mill limitation is insufficient to maintain fire apparatus, appliances, buildings, or sites therefore, or sources of water supply and materials therefore, or the establishment and maintenance of lines of fire alarm telegraph, or the payment of the permanent, part-time, or payment of the firefighter employees contribution required under Section 742.34 of the Revised Code, or the purchase of ambulance equipment, or the provision of ambulance paramedic or other emergency medical services operated by a fire department or firefighting company, for the benefit of the Franklin Township Fire District.
Section 2. That it is necessary to levy a tax in excess of the ten-mill limitation for the purpose set for in R.C. Section 5705.19 (I)
Section 3. The question of such said tax levy shall be submitted to the electors of the Franklin Township Fire District at the general election to be held therein on Tuesday, November 4, 2008.
Section 4. Such tax levy shall be at a rate not to exceed three and eighty nine hundredths (3.89) mills for each dollar of valuation which amounts to thirty-eight and nine tenths cents ($0.389) for each hundred dollar of valuation for a continuing period of time and which levy is an additional levy.
Section 5. Such levy shall be placed upon the tax list and duplicate for the tax year of 2008 for collection in 2009: if a majority of the electors voting thereon vote in favor thereof.
Section 6. The Township Fiscal Officer is hereby authorized and directed to certify a copy of this Resolution #08-067, and the Auditor’s Certificate to the Board of Elections of Franklin County, Ohio , which Board shall make the necessary arrangements for the submission of such questions to the electors of the Franklin County Township Fire District at the general election to be held on Tuesday, November 4, 2008; as provided by law.
Section 7. All formal actions of the Board concerning and relating to the adoption of this resolution were adopted in an open meeting of this Board, and all deliberations of the Board and any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements.

RESOLUTION #08-062 (Amended) TAX BUDGET FOR 2009
Trustee Guyton moved to amend the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Ohio to approve the Township Tax Budget for 2009.

RESOLUTION # 08- HIRING OF SUZANNE COULTER
Trustee Guyton moved for the adoption of the following resolution.
BE IT RESOLVED by the Board of Trustees of Franklin Township, Franklin County, Ohio, that the Board approves the hiring of Visiting Clerk, Suzanne Coulter at a rate of $25.00 per hour, plus mileage to help with the Tax Budget.

Trustee Cook talked about the salt bin. We need to have bids on fixing the bin or rebuilding.
Trustee Cook would like the awnings cleaned on the building and discussion was held in different ways to do this.
